1. GENERAL TERMS

By purchasing and using any digital products ("the Products") from Bobcat Planners ("we," "us," or "our"), you agree to these Terms and Conditions.

2. LICENSE TERMS

2.1. Upon purchase, you receive a non-exclusive, non-transferable, non-sublicensable license to use the purchased Product. You acknowledge that:

• Each Product's system requirements and compatible platforms (Microsoft Excel, Google Sheets, etc.) are specified in the product description
• It is your responsibility to verify your system meets these requirements before purchase
• You are encouraged to contact us through Etsy's messaging system with any compatibility questions before purchasing
• Internet connection is required for product activation and usage
• Our products are built with the latest version of Microsoft Excel. While we rigorously test our products, we cannot guarantee they work defect-free in all older versions of Excel.

2.2. You may:

a) Create multiple copies for your personal use, which is defined as:

• Use on your own personal devices (computers, tablets, phones)
• Creating backups for your own use
• Printing for your own use and record-keeping
• Using the Product for managing your personal, household, or individual professional activities

b) Collaborate with others (e.g., family members, colleagues) using the Product, provided that:

• The Product is not redistributed or copied by collaborators for their personal use
• Collaborators do not retain copies after the collaboration ends
• The collaboration is for a specific project or purpose
• You maintain control of the original Product throughout the collaboration

Personal use specifically excludes:

• Using the Product to create derivative products for distribution
• Sharing the Product through file-sharing platforms
• Installing the Product on public or shared computers where unauthorized users can access it
• Using the Product in an educational or training setting where multiple users need individual copies
• Using the Product to provide commercial planning or organizational services to others

2.3. The following activities are strictly prohibited:

• Redistributing, selling, or sharing the Product outside of the collaboration or purpose for which it was purchased
• Collaborators making copies of the Product for their personal use or redistribution
• Reverse engineering the Product
• Removing the Bobcat Planners branding
• Any attempt to bypass security features

3. ACTIVATION SYSTEM

3.1. Certain Products may include an activation system. For such Products:

• Activation is required using your order number
• License requires annual renewal of the activation code at no additional cost, subject to modification with 30 days' notice. Any modifications will apply only to future purchases or renewals
• Multiple unauthorized activation attempts may result in license termination
• Sharing activation codes with unauthorized users is prohibited
• The activation mechanism must not be removed or modified
• Failure to comply with activation requirements may result in suspension or termination of your license
• We monitor IP addresses and activation attempts for security purposes, including rate limiting of activation requests
• Automated temporary blocks may be applied to prevent abuse

4. MODIFICATIONS

4.1. You may modify colors, formatting, and visual elements of the Products.

4.2. Structural modifications affecting any Product's core functionality or security features are prohibited.

4.3. Required branded elements (e.g., logos, watermarks, or other identifying marks) and help documentation may not be removed

5. DISCLAIMER OF WARRANTIES

5.1. All Products are provided "AS IS" without any warranties, express or implied.

5.2. We do not guarantee the Products' suitability for any particular purpose.

5.3. We are not responsible for:

• Data loss or corruption
• Business interruption
• System compatibility issues
• Any direct, indirect, incidental, or consequential damages

In no event shall Bobcat Planners' total liability to you for all damages, losses, or causes of action exceed the amount paid by you for the Product. We are not responsible for any third-party claims related to intellectual property infringement arising from your use of the Product, except where such exclusions are not permitted by law.

6. REFUND POLICY

6.1. As these are digital products, ALL SALES ARE FINAL.

6.2. No refunds will be issued for any reason, including but not limited to:

• Change of mind
• Purchasing wrong version (Excel vs Google Sheets)
• Compatibility issues with older versions of Excel or Google Sheets
• Lack of software compatibility when requirements were clearly stated
• Feature requests or personal preferences

6.3. While refunds are not available, we encourage you to contact us through Etsy's messaging system should you encounter any issues. We will always do our best to help where possible.

6.4. You acknowledge reviewing all product requirements and specifications before purchase.

7. PRIVACY POLICY

7.1. For Products with activation systems, we collect and store:

• Etsy order information (order number, customer ID, purchase price, and purchase date)
• Operating system type (such as Windows, MacOS, iOS, Android) for product development purposes
• IP addresses for security and fraud prevention purposes
• Activation attempts and usage patterns to prevent unauthorized distribution

7.2. This information is:

• Used for verifying legitimate usage and preventing unauthorized distribution
• Used to improve product compatibility and development
• Stored securely and retained for no longer than 24 months after the termination of your license or the last activation attempt, unless a longer retention period is required by law or for legitimate business purposes.
• Never sold or shared with third parties
• Subject to applicable privacy laws including PIPEDA (Canada) and GDPR (EU)

The 24-month retention period ensures continuous access to activation services, including annual renewal capabilities and verification of licensing status. This period is necessary to maintain uninterrupted service for users who renew their activation codes annually.

7.3. You may request information about your stored data or its deletion by contacting us.

7.4. Our data collection and storage practices comply with Etsy's Privacy Policy and applicable privacy laws.

8. TERMINATION

8.1. We reserve the right to terminate licenses for:

• Violation of these terms
• Unauthorized distribution
• Excessive activation attempts
• Any attempt to circumvent security measures

9. INTELLECTUAL PROPERTY

9.1. All rights, title, and interest in the Products remain with Bobcat Planners.

9.2. The Products are protected by intellectual property laws.

9.3. No ownership rights are transferred through purchase.

10. GOVERNING LAW

10.1. These terms shall be governed by and construed in accordance with the laws of Quebec, Canada.

10.2. Any disputes shall be subject to the exclusive jurisdiction of the courts in Quebec, Canada.

10.3. If you are a resident of Quebec, you may have additional rights under Quebec's Consumer Protection Act.

10.4. If any provision of these terms is found to be unenforceable under applicable law, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

11. UPDATES

11.1. Product updates may be made available through our Etsy shop.

11.2. Updates are not automatically included with your purchase. While we often provide updates at no additional cost, this is at our sole discretion and is not guaranteed.

11.3. You may contact us through Etsy's messaging system regarding updates. Each update request will be evaluated on a case-by-case basis.

11.4. While we strive to improve our products, we do not guarantee:

• Future updates or improvements
• Bug fixes or compatibility updates
• New features or functionality

12. TECHNICAL SUPPORT

12.1. While not guaranteed, we typically provide support through Etsy's messaging system for:

• Installation questions
• Basic usage guidance
• Bug reporting

12.2. Support is provided at our discretion and may be limited or unavailable at times.

12.3. Support is only available through Etsy's messaging system.

12.4. Support does not include:

• Custom modifications
• Training or tutorials beyond provided documentation
• Integration with third-party software
• Business consulting or workflow advice

13. USER RESPONSIBILITIES

13.1. You are responsible for:

• Maintaining the security of your activation codes
• Keeping your contact information current
• Backing up your data and customizations
• Using the Product as intended and documented

14. THIRD-PARTY SERVICES

14.1. Products may integrate with or require third-party services (Microsoft Excel, Google Sheets)

14.2. We are not responsible for:

• Third-party service availability or changes
• Compatibility issues arising from third-party updates
• Data handling by third-party services

15. EXPORT COMPLIANCE

15.1. Products may be subject to export control laws

15.2. You agree to comply with all applicable international and national laws

16. BETA FEATURES

16.1. Some features may be marked as "beta" or "experimental"

16.2. Beta features:

• May be unstable or incomplete
• Can be modified or removed without notice
• Are used at your own risk

17. COMMERCIAL USE

17.1. For business or commercial use:

• Products may be used within your organization
• Products may not be used to create competing products
• You may not resell or sublicense the Products
• Usage metrics may be collected for licensing compliance
